1Article 1: Purpose of the Site
The Site enables the User to access, in particular, the following services: transfer of Client data between their real-estate CRM and website(s), migration of their real-estate data between their former and new real-estate CRM, contact management from their website(s), and management of these Services by a web and/or communications agency on behalf of the final real-estate Client.
The Site is a product of the company Ts-Services.
Ts-Services, under these Terms, grants Users a limited, revocable, non-exclusive, non-transferable right to access the Services strictly for personal use. Any use of the platform contrary to its purpose is strictly prohibited and constitutes a breach of these provisions.
2Article 2: Access to the Site
To be eligible for the Service, the User may be a natural or legal person.
Ts-Services reserves the right to suspend or refuse access by one or more Users to the Site.
3Article 3: Site Management
The Publisher implements the technical solutions necessary to enable continuous access to the site for the User. However, it reserves the right to limit or suspend access to all or part of the Site at any time and without notice.
Use of the Platform requires an internet connection and browser. All hardware and software necessary to access the Platform and use the Services remain exclusively the responsibility of the User.
4Article 4: Contact
Users may contact the Publisher with any questions or requests for information concerning the Site, or to report illegal content or activities, by email at contact@ts-immo.org.
5Article 5: User Obligations
Users are prohibited in particular from:
- Transmitting, publishing, distributing, recording or destroying any material, in particular Ts-Services content, in violation of applicable laws or regulations concerning the collection, processing or transfer of personal information.
- Disseminating data, information or content that is defamatory, offensive, obscene, violent or inciting violence, or that is of a political, racist or xenophobic nature, or any content that would be contrary to applicable laws and regulations or good morals.
- Referencing or creating links to any content or information available from Ts-Services sites, without the express, prior and written consent of Ts-Services.
- Using information, content or any data present on the Site to offer a service considered competitive to Ts-Services.
- Selling, exchanging or monetising information, content or data present on the platform or Services offered by the Platform, without the express and written consent of Ts-Services.
- Carrying out reverse engineering, decompiling, disassembling or otherwise attempting to obtain the source code.
- Using software or manual or automated devices, coding robots or other means to access, crawl, extract or index any page of the Site.
- Endangering or attempting to endanger the digital security of Ts-Services, including attempts to scan or test the vulnerability of the system or network.
- Counterfeiting or using products, logos, trademarks or any other element protected by Ts-Services' intellectual property rights.
- Disrupting or interfering, directly or indirectly, with Ts-Services, or imposing a disproportionate load on the Site's infrastructure, or attempting to transmit or activate computer viruses via or on the Site.
6Article 5.2: User Client Accounts
The Publisher reserves certain services for Users who have registered on the site, in particular paid services. Upon registration, the User undertakes to provide valid and truthful information.
Any User duly registered on the Site may request deletion of their customer account; the Publisher undertakes to delete customer accounts for which it has received such a request.
Customer personal data is deleted after 36 months without the customer having logged in.
7Article 6: Intellectual Property
All content on the Site, including designs, texts, graphics, images, videos, information, logos, button icons, software, audio files and others, belongs to Ts-Services, which is the sole holder of all intellectual property rights therein.
Any representation and/or reproduction and/or partial or total exploitation of the content and Services offered by Ts-Services, by any means whatsoever, without the prior and written authorisation of Ts-Services, is strictly prohibited and may give rise to legal proceedings.
8Article 7: Personal Data
All personal data held by Ts-Services is collected lawfully and fairly in accordance with the privacy policy.
Personal data is stored by Ts-Services for processing purposes in the context of using the Services. It is retained for as long as necessary for the provision of the Services and features offered by the Site.
The User always remains the owner of the information concerning them that they transmit to Ts-Services. They have, in accordance with French Law No. 78-17 of 6 January 1978, the right to access, rectify and delete personal data concerning them.
The User may exercise their rights by writing to the following email address: confidentialite@ts-immo.org. A response to the User's request will be sent within 30 days.
9Article 8: Liability
Ts-Services does not guarantee uninterrupted or error-free operation of the Services. In particular, Ts-Services cannot be held liable for any interruption of access to the Platform due to maintenance operations, updates or technical improvements.
In any event, Ts-Services shall under no circumstances be liable for indirect or unforeseeable losses or damages suffered by the User or any third party, including loss of profits, loss of clientele or loss of opportunity.
Furthermore, Ts-Services shall not be liable for any delay in or non-performance of the Contract justified by a force majeure event, as defined by French case law.
10Article 9: Evidence Convention
Computer systems and files constitute the binding record between Ts-Services and the User. Ts-Services may therefore validly produce, in any proceedings, as evidence, data, files, programmes, records or other elements received, sent or stored by means of the computer systems operated.
11Article 10: Severability
If any provision of the Contract is or becomes illegal or unenforceable, it will in no way affect the validity or enforceability of the other provisions of the Contract.
12Article 11: Dispute Resolution
The formation, interpretation and validity of this Contract are governed by French law, regardless of the User's country of origin and notwithstanding the principles of conflict of laws.
In the event of a dispute relating to the validity, performance or interpretation of this Contract being brought before the civil courts, it will be subject to the exclusive jurisdiction of the French courts.
The User is informed that they may in any event resort to conventional mediation or any alternative dispute resolution method in the event of a dispute.
13Article 12: Duration of the Terms of Use
These terms of use are entered into for an indefinite period; the User is bound to comply with them from the start of their use of the Services.
The Publisher reserves the right to modify this document at any time and without notice. Users will be informed of each update to the document.
